These Terms and Conditions (“Agreement”) govern the use of the WorkerAppz Payments platform and its services. By accessing or using the services provided by WorkerAppz Payments (“WorkerAppz”, “we”, “our”, “us”), you (“User”, “Client”, “Customer”) agree to comply with and be bound by this Agreement.
1. Introduction
WorkerAppz Payments is a service provided by SMA International Ltd. that allows for both business and individual money transfer services. By accessing or using our platform, you agree to be bound by these Terms and Conditions, as well as our Privacy Policy and any applicable laws or regulations governing financial transactions.
2. Services Provided
WorkerAppz Payments offers the following services:
- Business Transfers: International transfers for businesses, including multiple currencies and methods.
- Individual Transfers: Domestic and international transfers for individuals, including multiple currencies and corridors.
3. User Eligibility
To use WorkerAppz Payments services, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction.
- Provide accurate and complete information during the registration process.
- Comply with all applicable laws and regulations governing the transfer of funds and financial services in your jurisdiction.
4. Registration and Account Security
- You must create an account to access certain services. During the registration process, you agree to provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your account and password. Any transactions carried out using your account are your responsibility, whether or not authorized.
- You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
5. Payment Processing
- All payments made through WorkerAppz Payments are subject to review and approval, including necessary anti-money laundering (AML) and know-your-customer (KYC) checks.
- We may request additional documentation from you as part of our verification process.
- WorkerAppz Payments is not responsible for delays, errors, or omissions in payment processing due to incorrect information provided by the user or external systems.
6. Transaction Fees
- Transaction fees depend on the agreement made between WorkerAppz Payments and the client and will be disclosed prior to completing a transaction.
7. Transaction Limits
- Transaction limits vary based on the currency type and the nature of the payment.
- Requests for increased limits are reviewed on a case-by-case basis and are subject to approval by WorkerAppz Payments.
8. Turnaround Time (TAT) for Payments
- Swift Payments: In 90% of cases, Swift payments are completed within T+2 business days (excluding weekends, public holidays, and bank holidays). In specific cases where additional information, details, or RFIs are required by WorkerAppz Payments or the banking partners, the turnaround time may be longer. The cut-off time for processing is 3:00 PM Dubai Time, unless RFIs are raised.
- Euro Payments: Euro payments are generally credited on the same day, provided they are within the processing time. The cut-off time for processing is 3:00 PM Dubai Time, unless RFIs are raised.
- Individual Payments: These payments are typically processed in real time, unless RFIs arise, in which case the processing may be delayed. The cut-off time for processing is 3:00 PM Dubai Time, unless RFIs are raised.
9. Refund Policy
- Refunds are evaluated on a case-by-case basis. Refunds may be issued depending on the specifics of the transaction and the circumstances surrounding the request.
10. Dispute Resolution
- In the event of a dispute, please email operations@workerappz.com to raise any issues. We typically respond within 1 business working day.
11. Prohibited Activities
Please get in touch with operations@workerappz.com to receive a list of prohibited activities, including any countries or regions where transactions are not supported.
12. Limitation of Liability
To the fullest extent permitted by law, WorkerAppz Payments will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, including any delay or failure of processing payments.
13. Termination and Suspension
- WorkerAppz Payments reserves the right to suspend or terminate your account at any time if we believe you have violated this Agreement or if required by law or at the discretion of WorkerAppz Payments.
- You may terminate your account at any time by contacting your relationship manager or write to us on operations@workerappz.com.
14. Changes to Terms
We may update or amend these Terms and Conditions at any time. Any changes will be posted on our website, and the effective date will be updated. By continuing to use the services after such changes, you agree to the updated terms.
15. Governing Law and Dispute Resolution
- This Agreement shall be governed by the laws of Canada.
- Any disputes arising from or relating to this Agreement shall be resolved through binding arbitration in Canada, and the parties agree to submit to the jurisdiction of the courts in that location.
